We are seeking a litigation attorney to join our legal team as an Associate Counsel who will be directly responsible for handling all general litigation matters in Massachusetts from the filing of initial lawsuits through judgment (with a focus on breach of contract claims, creditor’s rights and other commercial matters). This Attorney will also manage external counsel in connection with any out of state litigation and assist with NFS’ prelitigation, default and workout matters. Any prior creditor’s rights, bankruptcy or insolvency experience is also a large plus. The ideal candidate will have a desire to make the move to an in-house position, and a willingness to “do whatever it takes” to thrive in a fast-paced and team-oriented working environment. This candidate must possess the relevant litigation experience.
Key Responsibilities include:
- Handling lawsuits from filing of complaint through judgment.
- Collaborating with internal restructuring and accounting teams with respect to preparing matters for litigation.
- Assisting with prelitigation matters in coordination with NFS’ “workout” team to resolve defaults and other disputes.
- Engaging and supervising external local counsel to handle out of state matters including recovery of collateral, domesticating and collecting upon MA judgments and any other applicable litigation.
- Assisting with other legal matters, including bankruptcy and insolvency, as necessary.
- Managing out-of-state dockets.
- Advising and providing legal analysis to business executives with regard to status of and strategy surrounding MA and out of state litigation.
Key Requirements/Qualifications:
- JD from a nationally recognized law school.
- Licensed attorney in the Commonwealth of Massachusetts.
- At least 3 years of commercial litigation experience.
- Detail oriented and accurate.
- Strong organizational skills and the ability to manage simultaneous projects under deadline pressure in a dynamic and fluid environment.
- Superior written and verbal communication skills.
- Ability to work both independently and in a team setting.
- Creditor’s rights, bankruptcy or insolvency experience a large plus.
